The Australian partner visa is designed for individuals who are in a genuine and committed relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. This visa allows the applicant to enter or remain in Australia on the basis of their relationship.

 

There are two main categories of the partner visa:

Onshore Partner Visa - Subclass 820/801

  • This visa is intended for applicants who are currently in Australia.
  • The subclass 820 is a temporary visa that allows the applicant to stay in Australia while the permanent subclass 801 visa is being processed.
  • Once the subclass 801 is granted, it allows the applicant to remain in Australia indefinitely.

Offshore Partner Visa- Subclass 309/100

  • This visa is for applicants who are outside of Australia at the time of application.
  • The subclass 309 is a temporary visa that allows the applicant to enter Australia and stay temporarily while the permanent subclass 100 visa is being processed.
  • Once the subclass 100 is granted, it allows the applicant to remain in Australia indefinitely.

Both visa subclasses require a genuine and ongoing relationship with an eligible partner. The applicant and their partner must meet certain criteria to be eligible, including:

  • The relationship must be genuine and ongoing, with a commitment to a shared life together.
  • The applicant and their partner must be at least 18 years old.
  • The applicant must meet health and character requirements.
  • The applicant must provide evidence of their identity and relationship.

Prospective Marriage  Visa Subclass- 300

The Subclass 300 visa, also known as the Prospective Marriage visa, is designed for individuals who are engaged to be married to an Australian citizen, permanent resident, or eligible New Zealand citizen. This visa allows the applicant to enter Australia and marry their intended spouse within nine months of visa grant. Here are some key points about the Subclass 300 visa:
  1. Purpose: The visa is intended to enable the applicant and their Australian fiancé(e) to marry and live together as a married couple in Australia.
  2. Eligibility Criteria: To be eligible for the Subclass 300 visa, you must meet certain requirements, including:
    • You must be outside Australia at the time of application and visa grant.
    • You must be at least 18 years old.
    • You must have met your fiancé(e) in person and be genuinely intending to get married within nine months of visa grant.
    • You must provide evidence of a genuine and ongoing relationship, including proof of your intention to marry, such as a statement from you and your fiancé(e), evidence of communication, and plans for the wedding.
  3. Visa Validity: Once granted, the Subclass 300 visa allows you to enter Australia and remain in the country for up to nine months. During this period, you must marry your fiancé(e) and can then apply for a partner visa to continue your stay in Australia as a spouse.
  4. Partner Visa Pathway: After marrying your Australian fiancé(e) and obtaining the Subclass 300 visa, you can apply for a partner visa subclass 820/801 (onshore) or subclass 309/100 (offshore) to continue your stay in Australia as a spouse.
  5. Application Process: The application process involves submitting the required forms, supporting documents, and paying the necessary fees. It is important to provide accurate and genuine information and meet all the eligibility requirements.
